According to police documents, singer Justin Timberlake told law enforcement, “I only had one martini and was just following my friends back home” after his arrest early Tuesday morning.

But Timberlake’s statement to police may not be accurate.

An onlooker told The New York Post that Timberlake was seen drinking someone else’s alcoholic beverage just before closing time. Specifically, when another patron left their drink unattended to use the restroom, Timberlake allegedly took the opportunity to consume it.

Officer Michael Arkinson of the Sag Harbor Village police force noted in his report that Timberlake displayed multiple indicators of intoxication. These included red, glassy eyes, alcohol on his breath, slurred speech and unsteady movement. The report also mentions that Timberlake declined to take a chemical test for impairment.

Police released a mugshot photo of Timberlake on Wednesday.

For his legal representation, Timberlake has hired local lawyer Ed Burke Jr. Speaking to Entertainment Weekly, Burke stated, “I’m prepared to mount a strong defense for Mr. Timberlake against these accusations. I’ll have more to say when appropriate, but for now, I’m waiting on the full details from the D.A.’s office.”

Despite this legal setback, Timberlake’s career seems to be proceeding as normal. His “Forget Tomorrow” world tour is still on track, with shows planned in Chicago this weekend and at Madison Square Garden in New York City next week. At a concert on Friday, Timberlake told the audience, “It’s been a rough week.”

The incident marks a rare brush with the law for Timberlake, who rose to fame as a member of the boy band NSYNC before launching a successful solo career spanning music and acting.
