David Cassidy, best known for starring in The Partridge Family, was arrested on suspicion of driving while intoxicated early Wednesday morning in upstate New York.

Cassidy, 63, failed to turn off his high beams as he approached a police checkpoint, calling attention to himself from the cops on duty, reported TMZ. At the checkpoint, Cassidy was subjected to a number of field sobriety tests, which he failed, according to Officer Jones. Cassidy also failed a Breathalyzer test after blowing a .1. Incidentally, the legal limit in New York is .08.

In 2010, Cassidy was arrested on suspicion of a DUI in Florida. Initially, the former child star intended to plea not guilty and fight the charges. However, after reviewing the evidence against him – dash-cam footage of his failed field sobriety tests and a .14 Breathalyzer reading – he opted to plea no contest to misdemeanor drunk driving and driving with an open container. As a result, he was placed on a year of probation and lost driving privileges for six months.

Since Cassidy has the prior DUI, he now faces a felony drunk driving charge. He was released from jail on $2,500 bail and is set to meet with a judge on Sept. 4.
