Kevin Spacey’s Lawyer Says It’s ‘Not A Crime To Have Sex, Even If You’re Famous’ In Assault Trial Closing Argument

In the closing statements of Kevin Spacey’s sexual assault trial, his lawyer Patrick Gibbs ended by stating it’s “​​not a crime to have sex, even if you’re famous.”

Gibbs continued by talking directly to the jurors and telling them that they must be “sure” of their decision, whichever they chose. 

“If you’re sure that he’s guilty, you’ll convict him. And if you’re anything less than sure it will be your duty — it might even be your pleasure — to find him not guilty,” he said in court. 

Spacey is currently facing nine different counts of sexual assault brought against him by four men. Four of the counts were dropped on Wednesday because of a “legal technicality.”

One of the charges includes forcing someone to engage in sexual activity that was penetrative without their consent and can carry up to a maximum sentence of life in prison. 

These four men have all testified in the past weeks over complaints that date back to the early 2000s. 

Spacey recently was in court for allegedly grabbing a man’s crotch while he was driving, which caused him to swerve and almost crash the vehicle. Spacey’s lawyers defended the actor by insisting that the actions between the men were “consensual.” According to this victim, this occurred in either 2004 or 2005 while the men were on the way to Elton John’s White Tie and Tiara Ball. John testified on behalf of Spacey to prove that he never attended the party in those years and only was there in 2001.

The second man claims that Spacey made comments toward him that were aggressive and sexual in 2005. After, Spacey is accused of grabbing his crotch while they were at a charity event. Spacey is denying these events.

The third victim stated that he met Spacey in 2013 in Gloucestershire at a pub. The man joined Spacey and his friends at his house where the actor attempted to kiss him and grab his crotch. Spacey has admitted to doing this and apologized for it, calling it a “clumsy pass.” 

The most serious accusation comes from the fourth complainant. Allegedly in 2008, a man fell asleep in Spacey’s apartment and woke up when Spacey performed oral sex on him without his consent. Spacey has defended these actions, saying that they were consensual and proved it by showing phone records that demonstrate the two had contact that night and the next few months. 

Before the trial ended, Gibbs additionally stated, “The reality is that false allegations, even apparently convincing false allegations, really do happen. Not always, but really do sometimes happen, especially where fame and money and sex and secrets and shame and sexual confusion are all in the mix.”

The jury will start deliberating on Monday.
