Britney Spears’ legal team has formally requested that Jodi Montgomery replace Jamie Spears as the conservator of the singer.

On Tuesday, Britney’s lawyer, Samuel Ingham, requested that Jamie resigned from the role, according to documents.

“Petitioner has requested that resignation of the current conservator of her person, James P. Spears, who temporally relinquished his powers effective as of September 9, 2019,” the document stated. “The within petition requests his replacement by Jodi Pais Montgomery, who has acted as temporary conservator of her person since that date.”

The petition also noted that the “Womanizer” singer “expressly reserves the right to petition for termination of this conservatorship.”

Jamie temporarily stepped down as her daughter’s conservator, which he has been since 2008, in fall 2019 due to health reasons. He still remains co-conservator of her estate with Bessemer Trust Company, as of November 2020.

If the request is granted, Montgomery would have permanent conservatorship of Britney’s person, giving Montgomery full control of the singer’s medical treatment.

In the filing, Ingham citied a 2014 order that said that Britney was incapable “to consent any form of medical treatment,” arguing as one of the main reasons why Montgomery should hold the position permanently.

Britney’s conservatorship reignited public interest after the documentary Framing Britney Spears was released earlier this year.

The next court hearing on the singer’s conservatorship will take place on April 27.
