A lawsuit filed by Richard Lee, against the city of Seattle to release the graphic photos taken by police at the death scene of Nirvana’s frontman, Kurt Cobain, was thrown out by a judge on Friday. Lee, a conspiracy theorist who believes the late Cobain was murdered, filed the suit in response to the city of Seattle denying his request for the city to publicize the photos and police reports under the Washington State Public Records Act.
The Seattle Times reports that King County Superior Court Judge Theresa Doyle dismissed Lee’s lawsuit over procedural grounds and ruled that not only Lee had failed to give Seattle enough time to respond to his request, but also that he did not deliver the suit to an appropriate recipient.
Lee, who has a Seattle public access TV show called Now See It Person To Person: Kurt Cobain Was Murdered, plans on filing another lawsuit. “Of course I will refile,” Lee said after the judge’s decision. “I’ve never heard of a case where an issue of such public importance was dismissed because of such trivial circumstances.”
His requests were heavily opposed and criticized by Courtney Love and Frances Bean Cobain, the widow and daughter of Cobain, who were both in support of the city of Seattle in wanting to keep the photos private. “I have had to cope with many personal issues because of my father’s death. Coping with even the possibility that those photographs could be made public is very difficult,” Frances Bean wrote, who along with mother, has not seen the photos. “Further sensationalizing it through the release of these pictures would cause us indescribable pain.”
Love said that the release of the death photos will pose a threat to their safety. “I am routinely called a murderer and receive death threats by conspiracy-theory obsessed individuals who believe I was somehow involved in my husband’s death,” Love said in a statement. “Public release of these images would only exacerbate such activity and further endanger my safety.”
