Sherri Shepherd failed to get out of paying child support for son born via surrogate with her ex-husband Lamar Sally.
The Pennsylvania Supreme Court has rejected Shepherd’s plea for her case to be reviewed once again, reported People magazine. Due to the court’s ruling, Shepherd will remain on the 1-year-old boy’s birth certificate, and will have to continue paying Sally $4,100 in monthly child support payments.
Shepherd and Sally’s child L.J. was born via surrogate in August 2014 after the couple had already broke up. L.J. had been conceived using Sally’s sperm and a donor egg, and the some-time actress and former The View co-host spent a total in excess of $100,000 to arrange for the surrogacy through Reproductive Possibilities.
“This ruling should give comfort to the surrogate and future parents,” Melisa Brisman, the founder of Reproductive Possibilities, told People. Brisman further called the ruling a “victory for reproductive rights.”
The ruling this week follows an April 2015 decision that stated Shepherd’s name would stay on L.J.’s birth certificate, and a November ruling by the Pennsylvania court of appeals to uphold the lower court’s previous decision.
According to Sally’s lawyer, Shepherd has yet to attempt to see their 1-year-old son.
