In a new attempt to defend Sean Combs, his lawyers have now claimed that drugs and alcohol so influenced his mental state due to his substance addiction that it would render it impossible for him to commit the many crimes for which he was accused in the upcoming trial.

In September 2024, Combs was indicted on charges of sex trafficking, among a host of other charges, including battery, assault and racketeering. At the last report in October 2024, over 120 survivors had stepped forward to report having been assaulted by the music mogul. Combs was arrested in New York City and is presently being held at the Metropolitan Detention Center in Brooklyn, with his trial scheduled to begin on May 5.

In February, one of Combs’ lawyers quit mysteriously, saying “he could no longer represent” him.

A testimonial from psychiatrist Elie Aoun hinted that Combs was incapable of committing the crimes he was accused of due to his substance abuse issue.

Prosecutors wrote in a filing, “The noticed testimony relates to the defendant’s diminished capacity to form the mens rea required to commit the charged offenses — in other words, a ‘mental condition bearing on the issue of guilt.’”

The term mens rea, which literally translates to “guilty mind,” and refers to the mental state of the defendant. Prosecutors must prove a defendant committed a crime with a “guilty mind” in order to convict.

Prosecutors objected to Aoun’s testimony. “If a defendant intends to introduce expert evidence relating to a mental disease or defect or any other mental condition of the defendant bearing on…the issue of guilt,’ he must provide notice to the government,” they wrote in a filing.

Combs has vehemently denied all allegations. In September 2024, Combs’ lawyer, Marc Agnifilo, issued a statement, “Sean ‘Diddy’ Combs is a music icon, self-made entrepreneur, loving family man, and proven philanthropist who has spent the last 30 years building an empire, loving his children, and working to uplift the Black community. He is an imperfect person, but he is not a criminal.

In support of the many accusations, multiple celebrities have confirmed having seen wild, so-called “freak-off parties” while at Combs’ infamous parties.
