Sean Combs’ Jury Expresses Concern Over One Juror’s Ability To Follow Judge’s Instructions
On Monday, the jury in Sean Combs’ sex trafficking trial ended the first day of deliberations without a verdict.
A juror in the case was previously replaced due to concerns regarding his place of residence – he initially reported himself as living in the Bronx, and later said he lived in New Jersey.
The jury, made up of eight men and four women, went to a private room to begin deliberations at roughly 11:30 a.m. Approximately 10 minutes later, they sent a note confirming they had an elected a foreperson.
At 1:25 p.m., the judge received a note from the jury that expressed doubts over one of the individual’s ability to follow instructions, and requested the judge question the juror. No additional information was provided concerning what instruction the Juror (Juror No. 25) had failed to follow.
Judge Arun Subramanian sent the jurors back a note reminding them of their duty to follow and uphold the law.
Later in the day, the jury sent another note requesting clarification as to the specifics of the drug distribution charge, questioning if giving drugs to an individual who asked for them qualifies as a crime. The judge replied he would respond on Tuesday.
The next day, the judge sent the jurors a note outlining a section of the charging document, reading, “The word ‘distribution’ means actual, constructive, or attempted transfer. To distribute simply means to deliver, to pass over, or to hand over something to another person, or to cause it to be delivered, passed on, or handed over to another. Distribution does not require a sale.”
Combs was arrested in September and faces two counts of sex trafficking, two counts of transportation to engage in prostitution and one count of racketeering. He has pleaded not guilty to all counts.
The prosecution has presented over a month of graphic evidence tying Combs to the crimes, supported by almost three dozen witnesses. Much of the trial has been focused on the alleged “freak-off” parties Combs held, at which federal prosecutors say Combs, “abused, threatened and coerced” women to participate in drug-fueled orgies.
The jury sent another note on Tuesday requesting the transcripts of Combs’ ex-girlfriend and key witness Cassie Ventura’s testimony’s well as the testimony of Daniel Phillip, who claimed he participated in the orgies. The judge responded that he would have the transcripts sent to the jury by 1:00 p.m.
