Justice Ruth Bader Ginsburg, 85, has missed three consecutive days at the Supreme Court, starting on Monday and continuing to Wednesday. Chief Justice John Roberts has called attention to her absence on all three days, saying his colleague was “unable to be present” but will still contribute her opinion. She’s using transcripts and court briefings to participate in the decision making process.
Justice Ginsburg’s absence on Monday was her first in over 25 years. She was diagnosed with lung cancer last month and she was released from the hospital on Christmas after her surgery. Ginsburg was hospitalized the preceding month as well, suffering three fractured ribs after falling in her office on Nov. 7. Her two malignant nodules were discovered while she was being treated for her ribs.

2018 wasn’t Ginsburg’s first time battling cancer – she was previously treated for colon cancer in 1999 and pancreatic cancer a decade later. Regardless, left-leaning people in particular are concerned for her health, especially given President Donald Trump had already appointed two justices to the Supreme Court’s bench. As it stands, the Supreme Court currently has five conservative judges to four liberal judges.
Ginsburg – affectionately known by fans as “Notorious RBG” – has indicated that she intends to continue serving on the court for up to five years should her health allow for it. Ginsburg began serving the Supreme Court in 1993, the same year Bill Clinton took office.
