Indio Downey, the 20-year-old son of actor Robert Downey Jr., has been charged with felony possession of a controlled substance.
The felony charge levied at Indio comes as a result of his arrest back in June, reported TMZ. Indio had been a passenger in a car in West Hollywood when cops pulled the vehicle over and allegedly found Indio smoking a substance out of a pipe. Authorities claim the son of the Iron Man star had cocaine in his possession.
Indio was also charged with misdemeanor possession of drug paraphernalia.
Since Indio is a first-time offender, he is entitled to a drug diversion program.
Robert Downey Jr., who battled drug and alcohol addiction when he was a rising star in Hollywood, released a statement upon his son’s initial arrest to thank the police for “their intervention” and to acknowledge that addiction tends to be hereditary.
“Unfortunately there’s a genetic component to addiction and Indio has likely inherited it,” he said in a statement. “Also, there is a lot of family support and understanding, and we’re all determined to rally behind him and help him become the man he’s capable of being."
“We’re grateful to the Sheriff’s department for their intervention, and believe Indio can be another recovery success story instead of a cautionary tale,” Downey added.
Indio first completed a rehab stint in 2013 after developing an addiction to prescription pills.
