Owen Labrie, the former prep school student who was sentenced to a year in jail and five year’s probation for the sexual assault of a fellow student, is seeking a new trial.
On Tuesday, Labrie filed a motion for a new trial on the grounds that he had inadequate defense in his original trial, reported NBC News. According to the motion, his defense team failed to turn its attention to discounting the felony count of using a computer to seduce a minor under 16. “The trial counsel’s failure to challenge the Computer Offense resulted in a miscarriage of justice,” the motion states.
Due to being found guilty on that charge, it is mandated that Labrie be on a sex-offender registry for the rest of his life.
During the trial last year, Labrie was also convicted of three counts of misdemeanor sexual assault and endangering the welfare of a child. He was acquitted of the most serious charges, three counts of felony sexual assault.
Labrie stood accused of raping an underage fellow student at St. Paul’s School in Concord, New Hampshire, as part of a ritual called The Senior Salute. Throughout the trial, Labrie maintained that his encounter with his accuser did not progress to intercourse, and that nothing that happened occurred without her consent.
