Following his arrest in New York for drunk driving, Justin Timberlake‘s license has been suspended in the state.

Timberlake pleaded not guilty to a misdemeanor charge in June. On Friday, he appeared virtually at his court hearing, where his lawyer, Edward Burke Jr., withdrew a previous motion to dismiss the case. The next hearing is set for Aug. 9.

In addition, Sag Harbor Village Justice Carl Irace threatened the defense with a gag order due to their claim that the singer “was not intoxicated.”

“The most important fact to know about this case is that Justin was not intoxicated and should not have been arrested for DWI,” Burke told People. “The police made a number of very significant errors in this case. In court today, you heard the district attorney try to fix one of those errors. But that’s just one, and there are many others. Sometimes the police make mistakes, and this is just one of those instances.”

Irace told Burke he should “be more mindful when giving comments.” 

Timberlake was arrested on June 18 for running a stop sign and swerving on the road. He allegedly refused a breathalyzer test and spent the night in jail. Tabloid reports claim that Timberlake was seen sipping his friend’s cocktail when the friend went to the bathroom.
