Miley Cyrus is being sued for copyright infringement by Tempo Music Investments over her 2023 hit song “Flowers.”
The company is alleging that Cyrus, 31, copied Bruno Mars‘ song, “When I Was Your Man,” which was released 10 years earlier. The lawsuit claims that Cyrus “intentionally” copied the song due to the similarities between both tracks.
Tempo Music Investment believes that the chord progressions in “Flowers” are the same as the progressions in Mars’ song and that some of Cyrus’ lyrics copy those of Mars’ track.
“It is undeniable based on the combination and number of similarities between the two recordings that ‘Flowers’ would not exist without ‘When I Was Your Man,'” Tempo claims in the filing.
The firm is demanding Cyrus pay a certain amount in damages, though this number is not known. It is also requesting that she and her label be barred from distributing “Flowers,” which may mean removing it from digital and future physical versions of her Endless Summer Vacation album. Tempo also wants Cyrus to be barred from ever performing the song again.
In 2019, Warner Music Group and Providence Equity Partners invested $650 million to create Tempo Music Investments, which is meant to invest in artists’ catalogs and take some control of their master recordings and publishing rights.
Tempo Music filed the lawsuit against Cyrus after reportedly taking control of part of “When I Was Your Man’s” copyright. In 2021, Mars sold a portion of his song catalog to Warner Music Group, though he retained majority ownership of his compositions.
“Flowers” won Cyrus her first-ever Grammy Award in February.
