On Thursday, New York State’s highest court rejected Lindsay Lohan’s appeal accusing that the maker of Grand Theft Auto V of invading her privacy and making characters in her likeness. However the court concluded that video game characters that the actress said were based on her did not resemble her.

Lohan believed that there were uncanny similarities between her and character from the game, Lacey Jonas, who called herself “really famous” and an “actress slash singer” as she tried to hide from paparazzi. She also objected to a similar depiction of a blonde woman, once shown being frisked by a police officer and in another wearing a red bikini taking a selfie with her cellphone and holding up a peace sign.
The lawsuit, which was filed back in 2014, stated, “The portraits of the Plaintiff [Lohan] incorporated her image, likeness, clothing, outfits, Plaintiff’s clothing line products, ensemble in the form of hats, hair style, sunglasses, jean shorts worn by the Plaintiff that were for sale to the public at least two years.”
The court did not agree with Lohan’s accusations. The state Court of Appeals called Take-Two Interactive Software Inc’s depictions “nothing more than cultural comment” in a 6-0 vote. They said it did not owe Lohan any damages.
Following the decision, Judge Eugene Fahey stated, “the amended complaint was properly dismissed because the artistic renderings are indistinct, satirical representations of the style, look, and persona of a modern, beach-going young woman that are not reasonably identifiable as plaintiff.”

This was not the first time this lawsuit was rejected, it was first rejected in September 2016.
Mob Wives star Karen Gravano was also part of the lawsuit over similarities of another character, but the court also rejected her claim, too.
A spokesman for Lohan had declined for a comment, and her lawyer Frank Delle Donne was not immediately available for comment. Take-Two also did not respond for requests for comment.
