Lindsay Lohan has gained some ground in her recent lawsuit against Rock Star Games, the publisher of Grand Theft Auto, because they used her image which she claims is in violation of New York civil rights laws.
The actress is alleging that the video game, which features a character named “Lacey Jonas” who the player helps escape the paparazzi, constitutes a violation of her rights under New York Civil Rights Law.
According to the amended complaint, the game references her lead in Mean Girls and the West Hollywood hotel where she once lived.
It also states that the publisher in merchandise has “used a look-alike model to evoke the persona and image” of Lohan by imitating a photograph that was once taken of her in 2007.
Rockstar tried to rebut the allegations by saying that it was legally meritless and that New York’s privacy law against likeness misappropriation doesn’t cover works of art.
But on Friday, Judge Joan Kennedy allowed her case to move forward on the basis that Rockstar’s reasoning wasn’t enough.
This means that Lohan is able to continue with her case against the gaming company.
