Almost three decades after the infamous murder of Kitty and Jose Menendez by their sons Erik and Lyle Menendez, a new court hearing has been set for the brothers for November 29.
Since the murder on August 20, 1989, the captivating story has returned to the spotlight, and Los Angeles County DA George Gascón announced that, with new evidence that the brothers were molested, they might be eligible for resentencing.
Gasćon said, “We’re not ready to say we believe or do not believe that information. But we’re here to tell you that we have a moral and ethical obligation to review what is being presented to us and make a determination.”
“We have been given evidence,” he said. “We have been given a photocopy of a letter that allegedly was sent by one of the brothers to another family member talking about him being the victim of molestation.”
In 2023, evidence came to light that Jose molested a singer of the Puerto Rican band Menudo, Roy Rosselló. In May of that year, Erik and Lyle requested a new hearing.
Although evidence of sexual abuse was presented in the brothers’ initial trial in 1996, it was withheld from the second trial, in which the brothers were sentenced to prison for life. The brothers had claimed they committed the murders out of fear of their father after they endured physical and sexual abuse throughout their lives.
The public’s renewed interest in the decades-old news story is partially because of controversial writer and director Ryan Murphy’s new series Monsters: The Menendez Brothers, which thrust Erik and Lyle back into conversation. Murphy’s show has been met with criticism, claiming that he exploited the brothers for their story and childhood abuse, as well as added false details, such as insinuating an incestuous relationship between the two.
In a statement from prison, released through his wife’s X account, Erik addressed the series: “It is with a heavy heart that I say, I believe Ryan Murphy cannot be this naive and inaccurate about the facts of our lives to do this without bad intent.”
In an unexpected show of support for the brothers, Kim Kardashian visited Lyle and Erik in prison and wrote an essay describing them as “kind” and “intelligent.” She wrote, “We owe it to those little boys who lost their childhood who never had a chance to be heard, helped or saved.”
