Kelly Rutherford, best known for starring on The CW’s Gossip Girl, has lost custody of her children to her ex-husband Daniel Giersch.

A judge in Monaco ruled this week to grant Giersh full custody of his children with Rutherford – son Hermes, 9, and Helena, 6 – and that Rutherford will only be able to visit them in Monaco or France, reported the Daily Mail. As for holidays, the children are to split Christmas, spring and summer vacations between spending time with Rutherford and Giersch.

Decisions regarding the children’s “health, schooling, religious education and any change of residence” are to be made jointly.

As per the ruling, Rutherford will also receive $3,281 a month from Giersch in maintenance.

“I have no words at this moment, no words,” Rutherford, 47, said as she left court, according to the New York Daily News. “I think like any parent would feel, you know. It’s their kids.”

Rutherford and Giersch have been in a protracted custody battle over their two children since their 2009 divorce. In 2012, a California judge ruled that Rutherford would have to visit Hermes and Helena in Europe since Giersch’s U.S. visa had been revoked. Rutherford was then granted sole custody in May of this year and her children were returned to her in the United States from Monaco, where they had been living with Giersch. In July, judges in California and New York both found that they did not have jurisdiction in the case and sent the matter back to a Monaco court.

Rutherford wed Giersch in 2006 and welcomed son Hermes shortly thereafter. The two divorced while she was pregnant with Helena.
