Justin Bieber Arrest Update: Blood Alcohol Level Registers Below Legal Limit; Singer Won't Leave Miami
Justin Bieber's blood alcohol level was too low for many to believe that he was as impaired as cops reported when they booked him for a DUI on Thursday. Bieber seems to agree, as he’s reportedly ignored the advice of his team to carry on partying in Miami.

Although it was initially reported that Bieber’s BAC was .04, it was later learned that it was significantly less, registering at just .014, according to TMZ. On the gossip site and elsewhere, the argument is being made that the BAC reading and the officer’s description of Bieber’s condition at the scene are contradictory.
“I immediately smelled an odor of alcohol emanating from the driver’s breath and bloodshot eyes,” read the police report. “The driver had slow deliberate movements and a stuper [sic] look on his face. These are all indicators of an impaired driver.”
Miami Dade Police Maintains Bieber's Impairment
Upon learning of the reports that claim the officer overstated Bieber’s impairment, Miami Dade Police Sgt. Robert Hernandez made the point that Bieber wasn’t only drinking alcohol prior to drawing the attention of police by drag racing with his pal Khalil.
"People have a lot of misconceptions about what people blow, especially in this case where Bieber made incriminating statements about the substances he had consumed,” Hernandez told the New York Daily News. “He is charged with DUI not DWI which means he was not necessarily drunk but was indeed "impaired" by a combination of cannabis, alcohol and prescription drugs.”
“He might not have been drunk but he was on other stuff,” Hernandez continued. “When someone blows under the legal limit we bring in a DRE – Drug Recognition Expert – which was done with Bieber and he determined that he was impaired."
The legal limit for blood alcohol level in Florida is .08, which means Bieber did blow far below the legal limit. However, at 19, he’s not legally allowed to drink, let alone get behind the wheel after consuming alcoholic beverages. And, as Hernandez stated, the pop star admitted to police – unwisely and of his own volition – that he’d taken prescription drugs and smoked marijuana prior to driving. Those substances, combined with alcohol, likely made him eligible for the DUI for which he was booked.
Bieber Refuses Scooter Braun's Help
Bieber, though, doesn’t seem bothered by his first arrest. Attempting to do some damage control, Scooter Braun and other members of Bieber’s team had a private jet waiting for him following his release from prison on Thursday. The plan was to pull him out of the hard-partying city and bring him back to Los Angeles, where he could try to repair the damage he may have done to his image and possibly head to rehab, reported the Daily Mail.
"'The private plane was on standby all day," a source told MailOnline. "It was really disappointing that he never got on it. Justin needs to get help now. [Justin’s team] wants him to get help and he doesn't want to get help so Justin is just avoiding his entire team. He's being defiant and not listening.”
Braun, who has managed Bieber from the start of his career, recently admitted that as Bieber has gotten older, it’s gotten more difficult to protect him, especially from himself.
"When Justin was younger, it was, 'Keep him out of trouble, stop him from falling down, protect him as much as you can from anything that can hurt him,' " Braun told The Hollywood Reporter. "When I try to do that now, he's resentful, he pushes away and rebels. What I've come to learn is: Be there, give the best advice you can, but he has to be allowed to make his own decisions – and his own mistakes."
For his first Instagram post since his release, Bieber uploaded a black and white snapshot of himself riding on top of the Escalade as it pulled out of the jail next to a similar image of Michael Jackson. The caption read, “‘What more can they say,’” followed by a crown.
