Judge Dismisses Kesha’s Allegations Against Dr. Luke

Kesha’s legal battle against producer Dr. Luke hit another snag Thursday, when a judge dismissed her claims against him.

Justice Shirley W. Kornreich of the New York State Supreme Court found that the case, as presented to her, did not prove Dr. Luke committed the crimes alleged, according to The New York Times.

“Kesha failed to plead that any of the alleged discrimination occurred in New York State or City,” Justice Shirley W. Kornreich wrote. She wrote that while Kesha has maintained that “she supplies no dates or specifics” and that “she failed to make the necessary allegations.”

“Although Gottwald’s alleged actions were directed to Kesha, who is female,” the judge add, the claims “do not allege that Gottwald harbored animus toward women or was motivated by gender animus when he allegedly behaved violently toward Kesha.”

Kornreigh added, “Every rape is not a gender-motivated hate crime.”

On Sunday, Kesha revealed on Instagram that she could have gotten out of her contract if she retracted her comments about Dr. Luke.

“so. I got offered my freedom IF i were to lie,” she wrote. “I would have to APOLOGIZE publicly and say that I never got raped. THIS IS WHAT HAPPENS behind closed doors. I will not take back the TRUTH. I would rather let the truth ruin my career than lie for a monster ever again.”
