As of Tuesday, Harvey Weinstein returned to court for his retrial, where a new witness accused him of assault.

News of Weinstein’s misconduct first broke in October 2017 when The New York Times reported that Weinstein had reached legal settlements with eight women who accused him of harassment over three decades. This report triggered a slew of accusations against the producer. Weinstein was accused of misconduct by over 80 women and sentenced to 23 years in jail in 2020.

Weinstein recently sued over “unsanitary conditions” at the Riker’s Island, New York, prison where he is being held.

In April 2024, the New York appeals court reversed Weinstein’s conviction of criminal sexual assault, justifying the decision with claims that the trial judge made an “egregious” move to let three extra women testify. A 4-3 decision in the court ruled that the then-judge was unfair in letting women take the stand when Weinstein had not been charged with their allegations.

The new trial covers the same allegations for which Weinstein was found guilty, with additional accusations added to the list. It is expected to last over a month, as three new accusers will come forward to confront Weinstein. Two of Weinstein’s accusers from the first trial, Mimi Haley and Jessica Mann, will also take the stand again to share their experiences.

Lindsay Goldbrum, an accuser’s attorney, told reporters on Tuesday morning, “I am confident that there will be justice in this case…It is important for women everywhere and for people who are victims of assault everywhere that others pave the way and show their dedication in the fight against assault.”

Juda Engelmayer, Weinstein’s representative, told TMZ a few days before the trial that Weinstein has gained 25 pounds in prison and was hospitalized earlier this year for a tongue infection, leading to a swollen tongue. Engelmayer said that Weinstein’s medical problems are worsened by “ongoing issues with missed and delayed medications, chest palpitations that go unaddressed and a lack of support for his serious mobility issues,” and his health is “rapidly deteriorating.”

Weinstein, 73, has diabetes and last year was diagnosed with chronic myeloid leukemia, a rare form of bone marrow cancer.

Weinstein has maintained his innocence throughout the ordeal.
