Halle Berry and Olivier Martinez, who have been married since 2013, have filed for divorce.

Berry and Martinez announced their decision to part ways in a joint statement Tuesday.

“It is with a heavy heart that we have come to the decision to divorce,” the couple told People magazine. “We move forward with love and respect for one another and the shared focus of what is best for our son. We wish each other nothing but happiness in life and we hope that you respect our and, most importantly, our children’s privacy as we go through this difficult period.”

Court documents indicate that the pair signed a prenuptial agreement. Berry maintains that she’s entitled to keep all of her earnings and assets per the agreement, however, Martinez plans to bring up the matter of spousal support at a future date.

Berry and Martinez have two-year-old son Maceo together. Berry is asking that the cost of raising Maceo be shared, and is seeking joint custody. Martinez is also seeking joint custody. One stipulation Berry has is that Martinez cannot take Maceo out of California without permission.

Raising Maceo in Los Angeles is said to have been one of the issues that led to the divorce. Berry and Martinez had long planned on raising both Maceo and Berry’s daughter with Gabriel Aubry, 7-year-old Nahla, in Martinez’s native France. Due to Berry’s ongoing custody battle with Aubry, the plan never came to fruition.

Other insiders claim that it was Martinez’s raging temper that did the couple in. He infamously brawled with Aubry on Thanksgiving in 2012. Earlier this year, he shoved an LAX employee with a baby seat, and is facing a $5 million lawsuit in the incident.

Berry met Martinez on the set of Dark Tide in 2010, the same year she split from model Aubrey. Berry and Martinez wed at France’s Chateau des Conde on July 13, 2013, and welcomed Maceo in October of that year.
