Model Kelleth Cuthbert is suing the self proclaimed “world’s finest water” company for the unauthorized use of photograph, likeness and identity after posing as the “Fiji Water Girl” at the 2019 Golden Globes.

Cuthbert was hired by Fiji Water to attend the Golden Globes and pose with bottles of the company’s iconic water. The model dressed in all blue and smiled coyly  in the back of many stars photographs at the event.

The model’s “photobombing” of celebrities took the internet by storm. The combination of her good looks and mesmerizing grin made it hard for Cuthbert not to catch people’s attention. Memes, jokes and laughs focusing on the model made her an overnight sensation.

But, the model is now suing the two companies that gave her the opportunity to walk down the red carpet and pose among stars. Cuthbert filed a lawsuit against Fiji Water Company and the Wonderful Company in the Los Angeles Superior Court. Cuthbert says a cardboard cutout was created the day after the Golden Globes using her image without authorization. She claims that Fiji Water Company and the Wonderful Company used this unauthorized image to launch a global marketing campaign.

Representatives of the companies don’t seem too worried, however. “This lawsuit is frivolous and entirely without merit. After the Golden Globes social media moment, we negotiated a generous agreement with Ms. Cuthbert that she blatantly violated. We are confident that we will prevail in Court. Throughout our history, we have had a sterling reputation working with talent.” a representative of the companies told E! News.

Since Cuthbert’s appearance at the Golden Globes she has been active on social media non-stop posting selfies, photoshoots and video shoots. She even has multiple photos of her acting as the Fiji Water Girl at the Golden Globes.

In Cuthbert’s third post showcasing the event, she shared a photobomb of the “Water Fountain” singer Alec Benjamin holding the Fiji Water Bottles in her bright blue dress.

One bold Instagram user decided to call her out in a comment posted underneath her original golden globes post.
