Tom Girardi, the estranged husband of Erika Girardi, star of the Real Housewives of Beverly Hills who is better known as Erika Jayne, has been diagnosed with dementia and late-onset Alzheimer’s disease.

The 81-year-old attorney went under a mental assessment on February 26 as part of a petition for his younger brother, Robert Girardi, to become his permanent conservator.

Amid multiple lawsuits filed against Tom, including being sued for embezzlement with his wife, Dr. Nathan Lavid, a Long Beach forensic and clinical psychiatrist, wrote a sworn declaration to the Superior Court of California on Wednesday stating that he is medically unfit to attend any court proceedings “for the foreseeable future. Dementia impairs his ability to understand the hearing. His emotional distress is directly related to his dementia and exacerbated by his confusion.”

Lavid also noted that there was a “moderate impairment” of Tom’s short-term memory, ability to concentrate, comprehension, recognition of familiar objects and places and logical reasoning.

Robert was granted a temporary conservatorship of his older brother until March 30 but he is planning to pursue a permanent extension.

Erika, 49, filed for divorce from Tom in November.

In the filing, Erika sought spousal support and requested that the court terminated their ability to award spousal support to Tom. He responded by asking the court to terminate her spousal support and that Erika payed all attorney fees and costs.
