Caitlyn Jenner risks facing a misdemeanor manslaughter charge in the deadly car accident on the Pacific Coast Highway earlier this year.
The Los Angeles County sheriff’s detectives plan to present evidence to prosecutors next week to show that Jenner could be guilty of misdemeanor manslaughter in the death of Kim Howe, reported the Los Angeles Times. According to the L.A. County Sheriff’s Department, Jenner was driving at an unsafe speed when her Cadillac Escalade hit Howe’s car, sending it into oncoming traffic where it was hit by a Hummer, leading to Howe’s death.
It was previously documented that Jenner was not exceeding the speed limit at the time of the Feb. 7 crash. However, the detectives believe that Jenner was driving at an unsafe speed for the road conditions on the day of the accident.
After the evidence is presented to the L.A. County district attorney’s office, prosecutors will decide whether or not to formally charge Jenner with misdemeanor manslaughter. Though the investigators plan to show that Jenner was in violation of a speed law, they do not plan to explicitly recommend a charge, according to KTLA.
If convicted of misdemeanor manslaughter, Jenner could face up to a year in prison.
Neither Jenner nor her lawyer has released a statement on the latest development in her case.
In addition to the criminal case, Jenner is also facing a civil suit for Howe’s death. Howe’s estranged stepchildren have filed a wrongful death lawsuit against Jenner, claiming that the Olympic gold medalist and reality TV star was “careless and negligent” in the events leading up to the car accident that left Howe dead, according to TMZ.
Following the deadly car crash, Jenner had released a statement to express her sympathy.
“It is a devastating tragedy and I cannot pretend to imagine what this family is going through at this time,” his statement read. “I am praying for them. I will continue to cooperate in every way possible.”
