Bruce Jenner is facing a wrongful death lawsuit stemming from Kim Howe’s death in the fatal car accident he was in earlier this year.

Howe’s estranged stepchildren filed the wrongful death lawsuit against Jenner, claiming that the Olympic gold medalist and reality TV star was “careless and negligent” in the events leading up to the car accident that left Howe dead, according to TMZ.

Jenner had been traveling behind Howe when he struck her Lexus on the Pacific Coast Highway, causing it to go into oncoming traffic and collide with a Hummer.

It was first reported early last month that Howe’s stepchildren were considering going after Jenner in civil court. They are Howe’s only surviving relatives, as she had no living direct relatives at the time of her death. After her husband died in 2003, she had little contact with the stepchildren. Despite the reported lack of a relationship, under California law, the stepchildren are entitled to file the wrongful death lawsuit.

The L.A. County Sheriff’s Department’s investigation into the February car accident is ongoing. It is thought unlikely that the L.A. Country District Attorney’s office will pursue a case against Jenner for Howe’s death.

Following the Feb. 7 accident, Jenner released a statement to express his sympathies. “It is a devastating tragedy and I cannot pretend to imagine what this family is going through at this time,” his statement read. “I am praying for them. I will continue to cooperate in every way possible.”
