On Monday, Bijou Phillips filed for divorce from Danny Masteron in a Santa Barbara, California, court. She cited “irreconcilable differences” as the reason to end almost 12 years of marriage.
In May, a Los Angeles jury found Masterson, the former star of That 70s Show, guilty of two counts of rape. Phillips, along with other family members, was present when Masterson was sentenced to 30 years to life in prison. The actor was seen blowing a kiss to his wife before being taken away.
In court documents, Phillips has requested to receive spousal support and to “terminate the court’s ability to grant support” to Masterson, with whom she shares a 9-year-old daughter. She also asked for full legal custody of their daughter, and that the couple’s assets be divided up by the court.
“Ms. Phillips has decided to file for divorce from her husband during this unfortunate time. Her priority remains with her daughter,” Phillips’ lawyer Peter Lauzon told TMZ. “This period has been unimaginably hard on the marriage and the family. Mr. Masterston was always present for Ms. Phillips during the most difficult times of her life. Ms. Phillips acknowledges that Mr. Masterson is a wonderful father to their daughter.”

Neither Masterson nor his defense attorney, Shawn Holley, have commented on the couple’s impending divorce. Holley has confirmed that Masterson plans to appeal his prison sentence.
