Ben Foster & Laura Prepon Accuse Each Other Of ‘Cruel & Inhuman Treatment’ In New Divorce Filings

Amid their tumultuous divorce, estranged couple Ben Foster and Laura Prepon have made allegations against one another for “cruel and inhumane treatment.”

On March 18, six months following their separation, Foster amended a divorce petition to accuse Prepon of “inappropriate marital conduct.” Foster had initially cited “irreconcilable differences” as the grounds for his and Foster’s divorce, but his amended petition alleges that he endured “cruel and inhuman treatment” from Foster, which rendered living with her “unsafe and improper.”

Prepon, one of the stars of Orange Is The New Black, responded the next day with the same accusation against Foster, adding he was “guilty of habitual drunkenness,” and asked for evidence of such inhuman treatment.

Foster’s petition requested that he and Prepon receive joint custody of their two children, asserting that both are “fit and proper” parents.

However, Prepon’s petition specifically states that she “denies that both parties are fit and proper parents to be awarded the joint care, custody and control of the parties’ minor children and demands strict proof thereof.” She requested that she be appointed the primary residential parent, stating, “This is in the children’s best interests.”

Prepon and Foster were close friends for years before they began to date in July 2016. They were engaged that October and welcomed their daughter the next summer. The two were married in June 2018 and Prepon gave birth to their second child in 2020. According to court documents, their official date of separation was September 9, 2024.

In a 2019 segment of The MOMS, Prepon shared about her home life: “Ben and I are really great about if I’m at work, he’s [at home], and if he’s at work, I’m [at home].”

She added, “[But] I do feel guilty, and I just know that [my daughter would] be proud if she knew. I’ve talked to a bunch of women [asking], ‘How do you do this?’ And they’re just like, ‘There’s really no solution. You just do it.’”
