On Tuesday, Harvey Weinstein’s lawyers filed a legal claim against New York City, arguing that he has received poor medical care and unhygienic living conditions while he is held in custody at Rikers Island. 

Weinstein was accused of sexual assault or harassment by over 80 women, victims of which provided a list of over 100 instances of abuse.

In the filing, his attorney claimed, “When I last visited him, I found him with blood spatter on his prison garb, possibly from IV’s, clothes that had not been washed for weeks, and he had not even been provided clean underwear – hardly sanitary conditions for someone with severe medical conditions.”

Allegations against Weinstein propelled 2017’s #MeToo movement’s campaign to raise awareness and combat sexual abuse, harassment and rape culture. The campaign led to a number of powerful men in the entertainment industry being called out for their abusive patterns, such as Charlie Rose, Louise C.K. and Kevin Spacey.

Weinstein was convicted of rape in New York in 2020 and convicted of rape in California in 2022, where he was sentenced to 16 years in prison. However, his New York conviction was overturned in April 2024 in the state in a 4-3 ruling, and the case is set to be retried in 2025.

He has maintained his stance that he is innocent.

Weinstein has a variety of medical conditions, including chronic myeloid leukemia and diabetes. An approximate 43% of prisoners in state and federal prisons have a chronic medical condition.
