Tracy Morgan is still “struggling” to recover from the many injuries he sustained in the car accident involving his tour bus earlier this summer.

Morgan, nearly two months from the New Jersey Turnpike wreck, still has a long way to go in terms of his recovery. "The truth is he's struggling, but he's fighting hard," Morgan's lawyer Benedict Morelli told the New York Daily News. “He's got the fighting spirit, but every day is different. Some days he's very down."

Morgan suffered a broken femur, broken nose and several broken ribs in the crash, which left his good friend and fellow comedian James “Jimmy Mack” McNair dead.

"It's not only physical, it's emotional," Morelli added of Morgan’s recovery on the Today show Monday. "Now, there's been a couple of people who said he's doing great. And that's not true. What is true is he's struggling and he's fighting."

On June 7, Walmart truck driver Kevin Roper crashed into the limo bus that was carrying Morgan and his associates. While Roper has been charged with one count of vehicular homicide and four counts of assault by auto for causing the accident – for which he’s pleaded not guilty – Morgan is suing Walmart, arguing that the company bears responsibility for its driver.

Walmart was careless and negligent in the ownership and operation of its motor vehicle, which caused Mr. Morgan to suffer severe personal injuries,” Morgan’s suit reads. “As a direct and proximate result of said collision, Mr. Morgan was caused to sustain severe painful bodily injuries, including but not limited to multiple fractures which required multiple surgeries, extensive medical treatment and will require significant physical rehabilitation.”
